03 Rules and Regulations

1) General
a) The “Watumi Festival & Fringe” event organisers are The Association of Support and Promotion of Artists, herein referred to as “The organiser” or “ASPA”
b) Watumi Festival & Fringe (herein referred to as WFF) is an artistic and cultural event created with the intention of offering a platform of exposure to artists from all corners of the world and of any artistic persuasion.
WFF principal objectives are:
•To facilitate access to culture and to actively promote the consumption of culture to the general public
•To offer a focal point for the consumption of contemporary art
•To encourage the creativity of Romanian artists
•To promote multiculturalism and to support intercultural exchange

2) Participants
a)Participants at WFF can take the form of any artist, group or company, regardless of citizenship, amateur or professional status and of any artistic inclination, herein referred to as “artist” or “participant”
b)There are no age restrictions, however, for minors, parent/guardian authorisation is required

3) WFF structure:
WFF is, by definition, two separate sections: Fringe and Festival
a) Fringe section, (being the major event) – has the advantage of being open to any artist, offering a very real chance to enhance their career prospects. The participants in this section can range between amateurs to professionals, novice to veteran in any artistic field. WFF does not offer any fees to the artists registered in the Fringe section and does not cover any expenses related to transport and insurance. WFF offers: • a platform of exposure; • a percentage of ticket sales; • the possibility of workshops and interactive activities; • accommodation in university campus, guesthouses and campsites - on a first come first served basis; exceptions are NGOs and production companies (separate arrangements); the cost of accommodation is 5 RON/person/day representing the cost of cleaning and maintaining the facilities; • student prices for meals provided at designated locations, reserved for artists; • promotion on WFF website as soon as registration is confirmed by the organiser; • promotion on ASPA website for 1 year after the event; • promotion in WFF programme brochure; • prizes in the last evening of the festival “Special Watumi Night”; • special guest access (entrance at WFF events and parties, access to accommodation and meals, etc…); • exposure in a dynamic and effervescent environment, the chance to be noticed by specialists; • great time
Any remuneration to the artists in the Fringe section is calculated by the organisers based on: general takings of WFF, takings at the specific event, number of spectators, the complexity of the event, technical and/or logistical needs and other aspects deemed relevant by the organiser. All aspects will be discussed on an individual basis with each registered participant.
b) Festival section – in this section, the artists’ participation will be based on an official invitation to the Festival section, sent by the organisers. The organisers will negotiate details with every artist invited to this section, on an individual basis.

4) Official dates and registration deadline
a) WFF runs from 22-26 July 2009. The deadline for registering to WFF is 12th July 2009, 5 PM. The event locations and accommodation are limited on a first come first served basis, therefore we recommend the participants to register as soon as possible.
b) We reserve the right to cancel, delay or modify the dates of the events due to reasons beyond our control.

5) Locations
a) The locations available to WFF are identified and provided by the organiser. The organiser reserves the right to decide the location of performances and art displays. They will take into account general requirements of WFF as a whole, as well as specific technical and logistical grounds in order to maximise each artist’s exposure.
b) ASPA encourages dialog and partnership between artists and private venues around Brasov. The artists who are planning their own events are encouraged to send the organiser their event schedule for promotion purposes at vreau@watumi.ro
c) The artist and their associates are held liable for any damages or losses incurred during their performance. The organisers reserve the right to take any reasonable measures to recoup any losses incurred.

6)How to participate at WFF, Fringe section
a) Artist can register at WFF with one or more creations, works, exhibitions, shows, actions, events, herein referred as “work” and/or “event”
b) Each artist has to complete the online registration form on the official website www.watumi.ro which implies the acceptance of the official regulations.
c) The artist has to complete a separate online registration form for each piece of their work or event
d) For the first year of WFF, the organisers have waived the registration fee
e) The artists that wish to withdraw from WFF must do so by 13th July 2009, 5 PM at the latest; after this deadline, a financial penalty of 50 euro + VAT will be imposed (this fee covers costs incurred in changing the schedule). Artists who fail to notify the organisers and are not present at their performance, exception being cases of force majeure, will be fined 250 euro + VAT (representing promotional material, logistics and technical expenses) The payment, calculated at BNR rate of exchange, must be made into ASPA account.

7) Conditions of participation, Fringe section:
a) Each artist is directly responsible for the content and the quality of the work registered with WFF: responsibility for the information offered, regardless of its nature, lies exclusively with the artists and its representatives registered with WFF, the festival organisers cannot be held responsible for any liabilities related to third parties.
b) It is forbidden for artists to utilise material that is controlled by copyright law without obtaining the relevant permission; it is the sole responsibility of the artist to insure the law is not broken
c) The artist guarantees that every work or event registered with WFF is either an original material not a copy or the artist has the legal rights of distribution/interpretation/use etc… of all the parts that form the work or event registered with WFF.
d) ASPA’s aim is to offer a smooth logistical operation with good communications, providing a positive experience for the general public. Therefore it makes an appeal to every artist not to register any material that instigates violence, racism, animal abuse, and pornography, works that discriminate against sexuality, ethnic/ religious minorities or people with disabilities. The organisers reserve the right to withdraw any material listed above and anything that might gravely affect minors’ physical, mental or moral development.
e) Artists registering theatre production with WFF are requested to send a DVD of their performance (minimum 10 min.) to “Watumi Festival & Fringe, Str. Constantin Kiritescu nr. 26 ap. 1, 024037, Bucharest, F.A.O. Camelia Hancu. The purpose is to help the organisers with the logistical integration of the show.
f) Artists who register short/feature/animation films are requested to send them either on DVD or in digital format (avi, mpg) to“Watumi Festival & Fringe, Str. Constantin Kiritescu nr. 26 ap. 1, 024037, Bucharest, specifying the registered category on the envelope or in digital format via a method discussed previously with the organisers.
g) Any CD/DVD delivered via mail, express courier or in person at the above address will not be returned. They will be kept in the WFF’s archive, without the organiser owning the copyrights.

8) Rights
a) One of ASPA’s main objectives is to promote the artists at national and international level. Therefore WFF organiser reserves the right to use artists’ material for promotion purposes.
b) The organisers reserve the right to reproduce, copy, publish, distribute or play works registered at WFF for the purpose of promoting the event.
c) ASPA reserves the rights to reproduce audio and video recordings and photographs of events for promotional purposes. Artists whose work is used for this purpose will not be entitled to any financial reward.
d) Artists participating at the event are encouraged to promote themselves at WFF. They are required to use “Watumi Festival & Fringe” logo on all the promotional material. Therefore ASPA allows the use of WFF logo free of charge for the duration of the festival period.

9) Legal responsibilities of all parties involved and legal requirements
a) The organiser reserves the right to modify the WFF’s schedule. They have the obligation to notify all parties involved, affected by the changes.
b) The organiser reserves the right to alter the content of the present regulations, informing all the registered artists via the official website.
c) For this edition of WFF, the organiser reserves the right to change the dates of the registration process if the number of registered artists exceeds the logistical capacity.
d) The organiser is exempt of any liability regarding the accuracy of personal data and registered/received materials by third parties.
e) The organisers have no liability and cannot be implicated in any litigation regarding the accuracy of data sent by the artists or their representatives.
f) Any programs that could affect or interrupt the functioning of the website or damage any software or hardware related to www.watumi.ro or its users are forbidden. Anybody causing damages, affecting or interrupting the functionality of www.watumi.ro by virus transmission can be prosecuted under the current laws.
g) We and all other web publishers have no control over the Internet, which is a global public network of computers and the method by which you access our website. As a consequence and in common with most web publishers we take no responsibility for service interruption or the transmission of viruses or other malicious computer code through our website.
h) Materials that deviate from the rules established in previous paragraphs will be modified/censored or removed by the organisers without prior notice.
i) We aim to resolve any dispute between the organisers and the artist in an amiable manner. Should this approach fail, the dispute will be forwarded to the local legal bodies in Brasov County.
j) Force majeure exonerates of all responsibilities the party that invokes it, during the whole period it is active. Causes of force majeure are considered situations beyond someone’s control, occurred after the artist’s registration, unpredictable and unavoidable, that attract someone’s absolute inability to participate at WFF, as per current legislation. The artist invoking force majeure has the obligation, within 5 days from occurring, to inform in writing the organisers of WFF and within 10 days to submit an official document confirming the existence of such a situation.

Final note: Completion of the registration form implies the acceptance of the WFF regulations
